1. Introduction

These Terms and Conditions govern the provision of web design and related services by White Cloud ("we", "us", "our") to clients ("you"). By engaging our services, you agree to these terms. White Cloud is operated by Jay, based in Christchurch, New Zealand.

2. Services

White Cloud provides website design and development services as described in your chosen package (Cloud One, Cloud Plus, or Cloud Pro). The specific deliverables, timeline, and revisions included are as described on our website at the time of purchase.

We reserve the right to decline any project at our discretion.

3. Payment

Work will not commence until the deposit has been received. We accept payment by bank transfer or as agreed.

4. Revisions

Each package includes a set number of revision rounds as specified on our pricing page. A revision round means one consolidated set of changes provided by you. Additional revisions beyond the included rounds may be quoted separately.

5. Client Responsibilities

To deliver your website on time, we require you to:

Delays caused by late content or feedback may result in a revised delivery timeline.

6. Intellectual Property

Upon receipt of full payment, you own the final website design and content created for your project. We retain the right to display the completed work in our portfolio and marketing materials unless you request otherwise in writing.

Any third-party assets (stock images, fonts, plugins) remain subject to their respective licences.

7. Hosting and Domain

Hosting and domain registration are not included in our packages unless specifically stated. We will recommend suitable providers and assist with setup, but ongoing hosting and domain costs are your responsibility.

8. Care Plans

Monthly care plans are provided on a rolling month-to-month basis. Either party may cancel with 30 days' written notice. No refunds are provided for partial months.

9. Limitation of Liability

White Cloud is not liable for any indirect, consequential, or incidental losses arising from the use of your website. Our total liability is limited to the amount paid for the relevant service.

We do not guarantee specific search engine rankings, traffic volumes, or business outcomes from your website.

10. Cancellation

If you cancel a project after work has commenced, the deposit is non-refundable. If work has progressed significantly, a pro-rata fee may be charged for work completed.

11. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the New Zealand courts.
